E911 Disclaimer

When you call 911, your telephone service provider registers your location including the street number, address, town, and country. This information is crucial for emergency dispatch to locate you in case you’re unable to communicate your location. Therefore, if you change your phone’s physical address, it’s imperative to inform Kapture Media Services (KMSIT) so that they can update your address record. Failure to do so will not hold KMSIT responsible for any inconvenience caused. To update your account, please refer to our contact information provided below.

Please note that your physical location is only shared with 911 services and not with any other call you make. Hence, this feature won’t work for other emergency numbers.

IMPORTANT 9-1-1 INFORMATION

We want to make sure that you are aware of important differences in the way 9-1-1 service operates with a VoIP phone when compared with traditional telephone service. Here’s what you need to keep in mind:

Differences between traditional 9-1-1 service and VoIP phone 9-1-1

With traditional phone services, your 9-1-1 call is sent directly to the nearest emergency response centre. With VoIP phone service, your 9-1-1 call is forwarded to a third-party service provider that will automatically or manually route your call to the emergency response centre.

Remember to provide your location

Because you can move your VoIP phone between locations and because, for technical reasons, the emergency operator may not have your name, location or contact information available, you must immediately inform the emergency operator of your location and contact particulars any time you call 9-1-1. Do not risk sending police or ambulance services to the wrong location.

Be prepared during any service interruption

VoIP phone service depends not only on your continued subscription (and payment) for the service, but also on Internet connectivity and power to function. In the event of power, network, or Internet outages (including congestion), or if your service is disconnected or suspended due to non-payment, you may experience a failure, disruption or delay in your 9-1-1 service. We recommend that you keep an alternative phone service (such as a cellular telephone) handy to increase the reliability of your access to emergency services during any service interruption.

Do not disconnect

Until you are told to do so by an emergency dispatcher, do not disconnect your 9-1-1 call. If you are inadvertently disconnected, call back immediately.

Keep your service address up to date

KMSIT will attempt to provide the emergency operator with your service address, so please ensure that your information on file with us is always accurate and updated. If you do not do this (for example, if you are unable to speak during a 9-1-1 call), the emergency operator may assume that you are calling from the last registered address.

Inform other users

You must notify members of your household and other potential users of your VoIP phone service of the nature and limitations of 9-1-1 emergency calls. To make this easier, attach the included stickers in a visible location on your telephone sets.

Limitations of liability

KMSIT’s terms of service limit and disclaim liability related to VoIP 9-1-1 service, so please read these carefully:

KMSIT allows its customers to make and receive calls through the customers’ internet provider. Usually, VoIP services have some restrictions comparing to landline services. By accessing and using KMSIT services, the customer accepts and agrees that there are differences between a traditional phone service and a VoIP phone service, including the 9-1-1 emergency service.

Due to recent pursuant CRTC rulings and regulations, all customers who are using KMSIT services as their primary residential or business telephone carrier must activate 911 Emergency Services on at least one of their DIDs. By the present Terms of Service, the customer agrees to comply with such regulations and understands that the Company will assume no liability in case of any breach of said regulations by the customer.

The portion of the 911 service which delivers physical address information to your local PSAP (public-safety answering point) is not guaranteed. It is possible that your physical location will not be provided to the PSAP dispatcher. On occasions of this kind, it will be your sole responsibility to give the dispatcher the location of your emergency to receive emergency service assistance, and the Company shall assume no liability to that extent.

Due to the quality variability of VoIP networks, KMSIT cannot and does not guarantee your emergency call will go through. Many conditions such as loss of power, Internet access and or several other may cause 911 to be inoperable. KMSIT does not have control over those types of situations and therefore can not be held liable. KMSIT will do everything within its reasonable power to prevent service outages within its network.

For e911 (enhanced 911) address information to be passed to your local PSAP dispatcher, The Customer must Define the outbound caller ID value to the specific DID (Direct Inward Dialing) you are qualifying e911 service for. Therefore, by subscribing to the Service, the customer is deemed to have supplied the outbound Caller ID number to the DID they have enabled e911 services for when making an outbound 911 emergency call.

By using KMSIT’s enhanced 911 service, the customer agrees that KMSIT, its contractors, executives, members, customers, agents, employees, carriers, 911 providers, and anyone else associated with KMSIT is not held liable for emergency calls failing, even if it is determined that it is the fault of KMSIT or its associates, and releases the Company from any and all liability. Customer further agrees that they will notify their customers, contractors, agents, employees, associates, shareholders, partners, and anyone who may use the KMSIT 911 service of our limitations and make customers agree to not hold KMSIT or customer liable.

KMSIT reserves the right to make changes to its site, services, policies and these Terms of Service at any time.
